    ADGM Registration Authority Publishes Consultation Paper on proposal to enact Undeveloped Commercial Land Regulations

    The ADGM Registration Authority (the “RA”) has issued a Consultation Paper to seek public feedback on a proposal to issue new Undeveloped Commercial Land Regulations (the “Regulations”).

    The proposals in this Consultation Paper would be of particular interest to landowners of vacant commercial plots, developers, and more generally to all individuals and organisations with a presence in ADGM and their professional advisors.

    The proposed Regulations relating to undeveloped commercial land within ADGM seek to encourage the timely development of commercial land, promote its efficient utilisation, and support the regulation of undeveloped commercial land across Abu Dhabi.

    Key proposals include:

    • Application of the Regulations to vacant commercial plots that are capable of development and supported by the necessary infrastructure.
    • A six-month grace period for plot owners to apply for a building permit before an undeveloped land fee may apply.
    • Requirements to submit evidence of a notice of commencement of construction and to progress construction within prescribed timeframes before the undeveloped land fee may apply.
    • The undeveloped land fee is calculated at 2% of the plot's fair market value for qualifying plots that remain undeveloped.
    • Limited exemptions and extensions where development is prevented by infrastructure, legal, or administrative constraints.
