Federal Legislation establishes ADGM as a Financial Free Zone

Article 121 of the UAE Constitution contemplates the division of legislative jurisdiction between the federation and each Emirate. In year 2004, Article 121 was amended in order to extend the legislative jurisdiction of the federation to include regulating the establishment of Financial Free Zones and the scope of exempting such zones from the application of federal legislation.

Federal Law No. (8) of 2004

This Law allows establishing a Financial Free Zone in any Emirate of the UAE, by Federal Decree. It exempts Financial Free Zones and Financial Activities from all Federal civil and commercial laws. However, UAE criminal law still applies.

Federal Decree No. (15) of 2013 and Cabinet Resolution No. (4) of 2013

The Federal Decree and Cabinet Resolution established ADGM as a Financial Free Zone on Maryah Island in the Emirate of Abu Dhabi. The area is 114 hectares.
