ADGM proposes to introduce regulations to facilitate electronic transactions, electronic records and electronic signatures. ADGM has issued this consultation paper to invite public feedback and comments on those regulations.

The proposals in this consultation paper will be of interest to ADGM entities and investors, and those wishing to establish a presence in ADGM or otherwise doing business in ADGM, and their professional advisors.

The Financial Services Regulatory Authority has published this consultation paper including a number of proposed amendments to the regulatory framework for Authorised Persons undertaking the Regulated Activity of Providing Money Services.

The proposed amendments reflect the growing importance of money services in ADGM and the region and include amendments to the FSRA’s Financial Services Markets Regulations 2015 (“FSMR”), Conduct of Business Rules (“COBS”), the Prudential – Investment, Insurance Intermediation and Banking Rules (“PRU”), the Anti‐Money Laundering and Sanctions Rules and Guidance (“AML”) and others.

Consultation Paper No. 5 of 2019 – Updates to the Prudential - Investment, Insurance Intermediation and Banking Rulebook

The Financial Services Regulatory Authority (FSRA) of Abu Dhabi Global Market (ADGM) has published a consultation paper setting out a number of proposed updates to its “Prudential – Investment, Insurance Intermediation and Banking (PRU)” Rulebook. The proposals cover the prudential supervision of banks, insurance intermediaries and investment firms operating within and from ADGM’s jurisdiction and would align its internationally recognised prudential regime more closely with the regulatory framework developed by the Basel Committee on Banking Supervision (BCBS). The main proposals are in relation to the Net Stable Funding Ratio, Large Exposures, disclosure requirements and further, miscellaneous amendments that will provide greater clarity to institutions operating in ADGM.

The Financial Services Regulatory Authority would like to invite public comments on the proposed revisions to ADGM’s regime for combatting money laundering, the financing of terrorism and proliferation, and the financing of unlawful organisations. The proposed revisions to the existing anti-money laundering regime have been formulated in the context of a recent review of the federal criminal laws of the UAE in relation to money laundering, terrorist financing and the financing of unlawful organisations.
