    ADGM Courts Notary Public
    Digital Innovation at the Heart of Notarial Services

    In partnership with Abu Dhabi Judicial Department (ADJD), ADGM Courts Notary Public offers Notarisation and non-Muslim Wills services.

    ADGM Courts Notary Public is licensed and authorised by ADJD to carry out the following activities under Law No. (11) of 2017 concerning the Notary Public in the Emirate of Abu Dhabi (the Law):

    • notarisation of documents
    • notarisation of non-Muslim Wills, and
    • to practice all the functions under the Law.

    Documents requiring notarisation must not:

    • contravene the Law or public order
    • fall under the notary prohibitions set out in the Law, or
    • fall under any other local jurisdiction, as prescribed in Article No. (11) of the Law.

    Services

    The Notary Public can notarise: 

    • Documents as required under the Law or as requested by a client
    • Specimen signatures
    • The verification of the date of documents, and
    • Declarations and affirmations.

    Fees

    Fees for the ADGM Courts’ Notary Public service are payable to ADGM Courts and ADJD pursuant to Law No. (13) of 2017 Concerning the Judicial Fees in the Emirate of Abu Dhabi, as set out in the following Schedules:

    Once your request is accepted by the Notary Public, a payment link for the ADGM Courts Fee will be shared via email. It must be paid via credit card before scheduling of the appointment with the Notary Public and is non-refundable. If the request cannot be completed by the client, the request will be cancelled, and the fee will be fee retained by ADGM Courts as the review of the documentation has already been actioned.

    ADJD’s fees are sent via SMS and are payable at the time of your appointment with the Notary Public.

    What are the essential criteria for document(s) to be accepted for notarisation?

    The document must be in bilingual format (Arabic and English) certified by a legal translator licensed by the UAE Ministry of Justice unless there is a requirement for the document to be in Arabic.

    The document must also include the following information:

    For Entities’ document(s) for notarisation:

    Personal information of the authorised signatory(ies)

    • name as stated in the Emirates ID for UAE residents and/ passport for non-UAE residents;
    • nationality;
    • Emirates ID number for UAE residents and/ passport number for non-UAE residents; and
    • capacity

    Company information as stated in the commercial licence:

    • name;
    • legal entity type;
    • name of the licensing authority;
    • registration number; and
    • company address.

    For Individuals’ document(s) for notarisation

    Personal information of the authorised signatory(ies):

    • name as stated in the Emirates ID for UAE residents and/ passport for non-UAE residents;
    • nationality;
    • Emirates ID number for UAE residents and/ passport number for non-UAE residents; and
    • capacity

    The document must be signed by the authorised signatory(ies) in handwriting on all pages. DocuSign and electronic signatures are not accepted.

    My name appears on the commercial licence as the company’s authorised signatory. Do I have the authority to sign documents for notarisation on behalf of the company?

    The fact that your name appears on the commercial licence does not authorise you to sign documents for notarisation on behalf of the company.

    You may be authorised to sign documents for notarisation on behalf of the company if:

    • you are a shareholder or director of a company and are granted this authority pursuant to the ADGM Companies Regulations 2020; or
    • you hold a power of attorney or shareholders’/ board of directors’ resolution (authority document) granting you the authority to act and execute documents on behalf of the company. The authority document must be either notarised by a notary public, or if the applicant is an ADGM entity the authority document can be certified by the ADGM Registration Authority (RA) with a notary pack.
    What is a notary pack? And how can I submit a request for it?

    A notary pack is a service offered by the RA to certify an authority document of an ADGM registered entity for notarisation purposes, in which the RA provides the following two letters along with the certified authority document: (a) declaration letter which confirms the validity of the authority document, and (b) a directors’ powers letter which lists the directors and confirms their powers in accordance with the ADGM Companies Regulations. The Notary Public requires a notary pack certification only if the applicant selects to certify the authority document by RA. To apply for this service, please contact RA at: ra@adgm.com for further assistance.

    If there are several authorised signatories involved in a single notarisation, do all authorised signatories need to be present at the same appointment or can each person attend separately?

    Yes, all authorised signatories must attend the same appointment before the Notary Public to confirm their knowledge of the content of the document for notarisation.

    Can the Notary Public notarise articles of association of a company based in Abu Dhabi but outside the ADGM?

    No, the Notary Public will not notarise articles of association and its amendments for an Abu Dhabi based company because the notarisation for such document falls within the competency of another authority (for example, Abu Dhabi Department of Economic Development).

    Services

    The Wills Office can only notarise non-Muslim wills for the below purposes:

    • Disposition of estate only
    • Guardianship of minor children only, or
    • Disposition of estate and guardianship of minor children.

    Fees

    Fees for ADGM Courts’ non-Muslim Wills service are payable to ADGM Courts and ADJD as follows pursuant to Law No. (13) of 2017 Concerning the Judicial Fees in the Emirate of Abu Dhabi:

    What are the essential criteria for a will to be accepted for notarisation?

    The will must be in bilingual format (Arabic and English) certified by a legal translator licensed by the UAE Ministry of Justice.

    The will must also include the following information:

      ▪ name as stated in the Emirates ID
      ▪ Emirates ID number, (applicable for UAE residents only);
      ▪ Passport number;
      ▪ nationality;
      ▪ date of birth;
      ▪ place of birth; and

    • Declaration of religion;
    • Appointment of executor(s) and statement of their powers;
    • Appointment of guardians (if applicable);
    • Identification of the beneficiaries and succession of beneficiaries including their name, nationality, date of birth, place of birth and address or if the beneficiary is a body corporate, the name, place of incorporation and commercial licence number.
    • Description of the estate to be distributed and the allocation amongst beneficiaries (if applicable); and
    • The applicable law: You may select UAE law and add a specific reference to article (17) of Federal Law No. (5) of 1985 on the Civil Transactions Law, by inserting the following paragraph:

    “It is expressly stipulated that this will is in accordance with Article 17 of Federal Law No. (5) of 1985 on the Civil Transactions Law of the United Arab Emirates and the amendments thereto and the substantive provisions governing testamentary disposition and other dispositions taking effect after my death shall be governed in accordance with the provisions of (e.g. this will). Shariah Law shall not apply in any circumstances.”

    Can the Notary Public notarise a will over assets located outside Abu Dhabi but in the UAE?

    Yes, the Notary Public can notarise a will if the assets are located within the UAE.

    Can the Notary Public notarise a will over assets located outside the UAE?

    Yes, the Notary Public can notarise a will if the assets are located outside the UAE. However, any grant of probate will be made in the jurisdiction in which the assets are located.

    Does ADGM Courts’ Notary Public and Wills Office provide a probate service?

    No, we do not provide a probate service. Probate applications must be registered with the ADJD’s Wills and Probate Office.
